BikerFM - The UK's Biker Radio Station

There is never a dull moment in today’s rock ‘n’ roll radio stats, but when it comes down to the smaller fish in the sea, it can never be taken for granted that they won’t spit gravel twice as far when it comes to how many listeners they have, or how they play the better music.

This was not far off the case for two Internet based Biker Radio stations this week, when the owner’s of Biker FM decided to hit a copy cat station for trademark infringement.

“How NOT to upset the apple coloured side car-t!”

Back in 2007, Suggsy Blackburn (AKA Kevin…. nice) decided to share his passion for bikes by posting video’s and comentary on one of the social video sharing sites. This went from one extreme to the other, with the purchase of the domain name www.BikerFM.co.uk so he could broadcast what he enjoyed the most, his style of music from the 70′s & 80′s.

On the 1st June 2009, a so called “fellow bike enthusiast” decides “I think I want a piece of this broadcasting pie” – and purchases the domain name www.TotalBikerFM.co.uk – which ends up being a competitive broadcasting station, which ruffled a few stands of leather on Mr Blackburn’s jacket.

Whilst “Suggsy” was let’s say relaxed about the whole situation for some time, there was obviously going to be a time when these two yolk’s were going to meet mudguard to mudguard in a battle for supremacy, or even worse – TRADEMARK infringement…

“trademarks are darker than your average doughnut on tarmac…”

As you would expect with anything legal, there will only ever be one winner…. the legal teams themselves. But, on his slightly pink unmodified road bike, Suggsy Blackburn set out to get the radio station’s name, BikerFM trademarked.

On Monday the 14th May 2012 – Mr Blackburn decided to announce to the owner of TotalBiker FM (Jason McGuire) that they had infringed on his trademark and must remove his website, social media channels including Facebook, Twitter and such like before legal proceedings would commence.

At this point, Blackburn gave McGuire the option to talk about it over the phone – which strangely enough, McGuire declined with the response that “he would prefer to communicate using chat or private messenger.” (don’t you just love 21st century business?) ;o)

So, having been advised of thise whole situation 24 hours ago, I decided to offer Mr McGuire the opportunity to chat with me using his “latest social chat gadget” which unfortunately didn’t go exactly how I had planned it. On entering his Biker Chat Room on a social media hosted by MySpace, all I witnessed was child like conversation about how, what and why they were going to do things to the owners of Biker FM.

My first comment went something like this;

“Just to be advised, if you are serious about making claims live in a public chat room about what you are going to do to someone or their business, be aware that this can now be extracted and used against you in court – sorry, this is advice only!”

So, there I was awaiting a reply from the moderator when all of a sudden, a notice appeared on my screen saying:

YOU HAVE BEEN BANNED FROM THIS CHAT ROOM!

Oh shucks – seems that I have upset someone in the chat room – ah well, I was only following his lead by trying to “jiggle with it” on his prefered communication platform… which saddens me ???? …. NOT!

With this in mind, I thought; “best ask Suggsy Blackburn” for his take on the situation

“I’m not saying that I’m the best communicator – but having tried to talk to this guy on more than one occasion, it fails me when I get a burbled message asking me if I want to **GO FOR IT!** ” said Blackburn this morning following an instant message from Mcguire.

When I asked Suggsy to pass me the message to read so I could edit it on to my article, I couldn’t help but weep once I read it – and hope you enjoy the share.

Mr McGuire said:

WHAT IS YOUR PROBLEM KEVIN? YOU SAID YOU WOULD GIVE ME TIME TO REBRAND. I SUGGEST THAT LESS THAN 24 HOURS IS NOT A DECENT AMOUNT OF TIME. GOING AROUND TELLING COMPANIES TO REMOVE OUR LINKS IS VERY BACKHANDED BUT IF THATS HOW YOU WANT TO PLAY IT, LETS GO FOR IT

In Blackburns’ defence, this was his reply:

As I told you yesterday, I would come back to you when I had spoken to the brief.  I havnt spoken to anyone since I spoke with you, although there is a very expensive enforcement team working on my behalf, so it may have been them.

Can I suggest you drop the attitude, I am trying to work with you here even though the legal team told me not to contact you.

Just remember you can’t have it both sides of the street.  I’ve even taken the slagging your presenters were giving us on the chin last night.

You come across as a sensible person, so please think before you threaten me, or we can terminate the conversation here and as you put it, lets go for it.

Well, I’m sure you have had about all you can take from the street. It seems as if the one company have a trademark, and the other people have infringed this. So, in light of the truth, there is only one thing I can say to close this extremely tense situation….

Dear Mr McGuire,

To save dropping a piece of bread on the floor a million times to see how or if the buttered side lands face down more, butter both side of the bread, grab a huge cup of coffee….

and GROW UP!

I look forward to your response by return – or maybe something slightly off beat from th elistener who banned me from the chat room last night.

This is no different with Pandora, the company who manufacture bracelets and beads for their world renowned Pandora Bracelet” which is bolstered by their beads, charms, necklaces, watches and rings.

At the bootom of the Promenade in Cheltenham, Hooper Bolton have been selling Pandora from the word go – and have been extremely successful with it too. But, as like I mentioned above, as soon as they started to progress with the Pandora product range, they suddnely decide to open a branch on the Lower High Street, about 400 yards from the Hooper Boltons Pandora Cheltenham store.

Although it may sound very unethical, it is a modern day practice for many of the mainline manufacturers and retailers, no matter what industry they are tied to. But, all the same – it comes to something when you do this only yards from the company who were retialing your products over the last few years.

Having explored the town centre, I found that there were a couple of Pandora retailers who were in competition with Hooper Bolton, but did not carry half the stock that they did. And, seeing that the Pandora Cheltenham shop is on the not so elequent end of the High Street, I would not be surprised if it has little, or no effect at all.

All I can say is best of luck to Hooper Bolton – a lovely little shop with bags of true zest, and always happy to see you when you walk in.

Every state of mind has a particular “signature” attached to it. This is represented by your brainwave patterns (or “frequency”).

For example, if you’re in a state of deep focus, your brainwaves are likely to be in the Alpha frequency range of 8-12Hz. Other specific frequency patterns exist for states such as sleep, creativity, and general happiness.

These frequencies can be measured using powerful scientific tools, such as an EEG machine. (Also known as an electroencephalograph machine.)
The discovery of brainwave entrainment

In the 1830s, scientists discovered that by playing certain frequencies through the ears, the brain “followed” those frequencies. This is a powerful process known as “brainwave entrainment.”

By changing your brainwave frequencies, you could change your state – encouraging focus, creativity, sleep, or mood improvement, for example.

The problem was that the human ear can only hear frequencies of around 20Hz to 20,000Hz – whereas the vast majority of ‘useful’ human brainwave frequencies exist at 0.1Hz to 20Hz.
Recreating brainwave frequencies

That’s when scientists did something really clever. They decided to play one frequency into the left ear (ie, 400Hz), and another into the right ear (ie, 410Hz).

The noises cancelled each other out and recreated the difference inside the brain (ie, 10Hz).

The brain then followed (or entrained) toward this frequency, and brought about the exact state of mind desired – such as deep focus.
Going beyond binaural beats

This was the scientific validation of “binaural beats,” the first true brainwave entrainment method. Originally suggested in the 1830s, it was scientifically verified by EEG machines in the 1950s.

Since then, many other methods of brainwave entrainment have been discovered – including monaural beats, hamonic box X beats, and most powerfully, isochronic tones, typically regarded as the most potent entrainment methods availabl.

Are Cheltenham Council Taking The ........

Another beautiful spring day, people out walking around the Cotswold town of Cheltenham – lapping up the sunshine, enjoying the walks in the gorgeous parks when suddenly that cry from a child; “I need the toilet!!!”

Well, it is happening right now in Sanford Park – just behind the Lido, where the council have a perfectly set out play area for children with swings and slides, climbing frames and a toilet facility which is “CLOSED” to the public. Yes, I appreciate that facilities need to be maintained, yes they have to be closed in the winter because of lack of use, but come on CBC, we have had two staggering weeks of sunshine and you still haven’t opened them.

Here is the problem: “We as a family use the facilities in Sandford Park on a regular basis, and I can’t remember once over the last 3 weeks when we have visited the play area with our son (who is 4 years old) and not found less than 8 or 10 children playing in the childrens area.

And hand on heart, I have seen on more than one occasion – parents having to suspend children in mid flight over shrubs and bushed area’s so they can relieve themselves. And please, don’t tell me “they can hold it till they get home!”

We contacted Cheltenham Borough Council and advised that the toilets were undergoing refurbishment, and would re-open on the weekend 16th/17th April – 2011. We arrived at the play area on Saturday to find them still “CLOSED” – so made another call this morning.

This time, we were given the number of John Reece who is in charge of the Council Public Amenities – he advised that there was a “blockage” issue, and that they had notified Severn Trent to investigate. In the mean time, he also mentioned that due to council cut backs, that there was no guarantee this facility would be opened in the future, and should we wish the take this further – to speak with Roger Whybourn MP.

We have now spoken to Roger Whybourn, who advised that this is not the only block of toilets to be closed – with Coxs’ Meadow having been closed as of the 1st April 2011.

At what point will these cut backs stop – do we need children to start playing in other childrens’ excretion, do they have to fall i’ll and cost the NHS more money for medical assistance, drugs and follow up checks… ???

The only way to get this heard is to stand up, bring the point to the table and see how long it takes the council to find alternative funding to keep health risk at a minimum – and remove some of those useless traffic wardens from the town centre, who find extremely long spells talking to taxi drivers parked in Royal Well, where they should not be parked anyway. (Yes, I got a ticket recently… fair cop.)

It’s hardly surprising to think that when the government decides to enforce something, 9/10 times the industry that they are trying to help start to sit up on their hind legs like Meerkat’s, looking like nothing is wrong and they didn’t need any government intervention.

So when government officials decided to release the possible cap on ticket re-sellers, why did the industry start getting so upset over something they don’t have anything to do with? Or do they?

This is going to have to be slightly tongue in cheek – but here is the reason:

• Ticket companies see the reseller situation and suddenly get the urge to do something “in house.”
• Some of the big companies spend thousands having websites built to sell “unused” tickets.
• One of these companies then begins to syphon tickets from big events before they go on sale.
• Now the rest of the industry want a bigger piece of the pie – so are doing the same.
• Why don’t they want a cap on resellers of tickets?

Do I need to spell it out any clearer than that?

In all honesty, the ticket industry are not concerned about the fraudsters who are selling the tickets for the big events, and scamming people out of hundreds, even thousands of pounds – they don’t care about the scam websites that pop up and sell tickets that don’t exist – they really don’t care about anyone else or anything else apart from their profit margin increase by using different methods to make more money from those who are TRUE fans.

So to wrap this in a nut shell, they have the tickets and you want to buy them – so even if you get scammed online by someone else, they know they would have sold all their tickets 3 times over – so why should they get concerned over scams?

And here is the real scary bit…

The government have put an anti-ticket scam website up too – so you can see what a scamming site looks like!!!

I’m not kidding here – the UK Government have decided to tackle this whole episode of ticket scamming, online ticket fraud and ticket resale by launching a website which is an “idiots guide” to spotting the type of website which may decide to take your money and not supply you the tickets you paid for.

It’s not the websites that are a scam – it’s the ticket industry that needs the kick up the backside – along with the credit card payment gateway’s for allowing these companies to even take online payments and run before the ink has even dried on the tickets!

Come on David, give the fans a break and do something construcive with the time you spend around the table – instead of tossing a coin and taking “best out of three” approach on what to do next!

The Nuneaton Rotary Walk which is organised by The Rotary Club of Nuneaton – will be going ahead as usual this year, no different to any other. This organised day has been going now for over 15 years, with many hundreds of people walking for charities around the Nuneaton and Warwickshire area – raising literally thousands of pounds for many great causes.

This walk of the outskirts of Nuneaton offers not only a great day for all of the family to join in and raise funds for your own causes, but also gives those on route the opportunity to come out and wish the walkers a safe day walking.

Amongst the charities which have benefit from the support of local people are: The People in Action Group, MacMillan Nursing, WRVS, Young Deaf, Mary Anne Evans Hospice plus unlimited amounts of Local Schools, Sports Clubs, Cub and Scout Groups with some National Charities too.

And for those who may have not taken part in the past – then here is a brief outline of what happens:

The classic walk is a circular route of 21 miles, mostly along footpaths and bridleways but it is divided into several sections with marshalling stations on route. Everyone completing the full route will receive a certificate celebrating their success! Additionally two other shorter routes of 3, 5 and 8 miles have been created for the more casual stroller and family groups, who would prefer to just amble and perhaps enjoy a pub stop on the way.

The Nuneaton Rotary Club organises the event on the understanding that you do the walking and seek out your own sponsors.

The Rotary Club of Nuneaton is pleased to announce the details of its first Junior Golf Tournament. The tournament will take place on 4th August 2011 at Oakridge Golf Course, with the kind permission of the Owners and Commitee.

A shield will be presented to the winner; this will be known as the Oakridge Rotary Shield and has been kindly sponsored by LDJ solicitors, Nuneaton. Medals will also be presented to the runners-up. The rules of the tournament will be based upon a Stableford Handicap competition in order to give every golfer an even chance.

The entrance fee will be £4.00 and food will be provided on the day.

In addition, and on the same day, it is planned to stage a putting competition for younger non-golfing children, for which there will be a nominal fee. It is hoped that this will encourage families to bring along younger siblings who might like to try golf in a friendly non competitive setting.
